Hmm, boot in safe mode and remove all instances of the modem under device manager.
If u can't get it to work, then maybe the modem is fried.
Before dumping it, try it on another system...
 
If the modem is hard set to IRQ3, then go into your system BIOS and reserver IRQ3 for the slot it is in (Legacy if ISA-16bit, PCI slot# if PCI modem). Then the software may find it. ;-)

Just remember that COM1shares with COM3 and COM2 shares with COM4 - you may have to play with other devices (ie, if using a serial port COM1, may conflict with COM3; some modems need a COM1 to work, however ... you will have to try it).

Add additional com ports

I had the same modem with the same problem. I solved this by adding additional com ports through the "add new hardware" option in the control panel. When I added com 6 and rebooted, the modem finally installed on com 5. Try it out. It can't hurt.
 
You are all overlooking the major problem here. It is so obviously the fact that he is using AOL that is causing the problems. Use a real ISP and your problems will all go away. They are a good starter ISP but once you know how to turn on the computer by yourself it's time to move on.:D :D :D
 
many thanx for all your help i have solved the problem, i shot the mother inlaw.... (just joking) i bought a new modem and it went in first time. once again a THANKYOU for everyones help,its nice to be part of abig family
