From CDFreaks, how I laughed at this story. The word hypocrisy comes to mind, but I'm sure they are sincere really, of course it's a backup tool only! :rolleyes:

One of the best known products for making 1:1 backups of DVD movies is probably DVDxCopy. The software that costs 99$ is developed by software company 321 Studios and the company is fighting for fair use laws in the United States.

In order to make their point that their software is intended for backups and not for piracy they have no offered a $10.000 award for tips leading to the conviction of anyone using their software for pirated copies.


The move is the latest attempt by St. Louis-based 321 Studios to demonstrate its anti-piracy fervor. That’s important because the major Hollywood studios want to ban 321’s products on the grounds that they promote piracy.

“We hereby claim their reward,” said Marta Grutka of the Motion Picture Association of America. “Any use of 321’s products on a copy-protected DVD is illegal, and the notion that there’s an ‘illegal misuse’ is therefore a complete misnomer.”

The two sides have taken their dispute to a federal court in Oakland, Calif., where a trial is scheduled to begin April 25. At issue is whether 321’s programs violate federal copyright law by enabling users to pick the electronic locks on DVDs and copy them.

Robert Moore, founder and president of 321 Studios, contends that most of his customers use the software to make backups of DVDs they own. The motion picture companies’ lawyers say the law doesn’t allow electronic locks to be circumvented.

The reward applies to 321’s latest product, DVD X Copy. The catch: The $10,000 would be paid only for tips that lead federal prosecutors to convict a pirate.



Fortunately we're sure none of our visitors have ever made a pirated copy, but only make personal backups, so I'm sure we will see none of you in court soon, but some other people should now be afraid for their neighbours.

doh lmao thanks for that laugh LAZ u sure this should not be in JUST FOR LAUGHS !? lmao :) are they DUMB or what !? they are still trying to convict "DVD" JON for cracking the DVD protection 3 years later lol and hes been acquitted on all charges ?!

but ....for a DVD duplication software maker to make such a stupid backward quote as this is just plain asking for trouble to come to them ?! whats the odds here that they themselves will get fined heavily for actually making a program to duplicate DVD'S and assume that we are all sweet little people that abide all laws !? yeah right NOT !!!!

JON was mearly making them play on his own LINUX system as there were no LEGAL means and i think there is still no LEGAL means of legitimatly playing yer own DVDS on your LINUX system !? maby im wrong now but at the time he cracked it there was NONE !?


Anyhow yet more COURT TIME wasted i spose :(

Silly MPAA, seems they want to kill every little product that THEY deem breaks the DMCA (Digital Millenium Copyright Act).

Sadly the DMCA was one of the dumbest things Bill Clinton ever signed into law. I mean we all have the right to make our own personal software backup according to the BetaMax ruling of 1984. Since Hollywood (Music and now Gaming industries as well) has always been pissed at this ruling, they have tried and tried to get new legislation into law that would derail this landmark case. Well in 1998, after multiple millions of dollars in contributions, it was passed and signed into law. Now with the DCMA, you still have the right to backup your software material, but NOT if it has the latest copy-protection..... ie, you are not allowed to circumvent it. Sneaky bastards aren't they?!

Not that all nations around the world abide by the DCMA (far too many western nations do), but please what your money won't buy you nowadays :rolleyes:

Sad to say but the MPAA and the RIAA will kill companies like 321 Studios. Even if they don't get their way, they will kill them with extended and drawn out court costs. Nice when you have millions of dollars to throw around now isn't it. :rolleyes:

Since quite a few nations do not abide by the DCMA, perhaps 321 Studios can move there..... hey it worked for Ollie and CloneCD ;)

Good point m8! ;)

I think we will be seeing a lot more software companies moving to such countries. Maybe Olli will start buying up land now in preperation for this? He would surely make a killing and add the title of "Property magnate" to his existing "Software genius" title! lol :D

Yesterday we reported that the developers of DVDxCopy put a reward of $10.000 on the head of those who are using their software to pirate movies. Reactions were pretty clear and people were amazed that this company would pay to get their own customers prosecuted. We asked Mr. Robert Moore, CEO of 321 Studios, why the company has done this.

The company is in a lawsuit with the MPAA (that claims DVDxCopy is damaging their revenues) and is fighting for a new law that should protect the right of fair use for consumers, which should allow people to make a backup of their movies and games. Currently this is not allowed due the strict digital law, the DCMA.


Q: Mr. Moore why have you put up this reward, do you want to prosecute your own customers?

A: People are using this product for its intended purpose ,and the purpose of the reward is to demonstrate the ludicrous position the MPAA takes in claiming DXC will significantly damage their revenue streams.

This is really in response to the MPAA branding us as a criminal and a thief and every one of our customers a co-conspirator. This is ludicrous and the reward is a direct challenge for any one to prove that our product is being used for piracy reaons.

We are no criminals and our customers are not criminals. We are consumers who wish to avail ourselves of our fair use rights and expectations





321 Studios seems not to fear any legal battle and again this action should make clear that someone who makes a personal copy is not a criminal.

I had read somewhere that 321 Studio also claimed that the product didn't violate the MDCA because it didn't crack DCSS when it copied the disks. Has anyone heard anything about this?

On another note, it seems to me that if I make a VHS copy, I'm not violating the MDCA because I'm not circumventing the encryption - I'm copying the analog stream after my player decrypts.
 
if you are removing the macrovision thats on 99.9% of all films when you copy them to vhs tape then this is also breaking copyrite laws as its modifying the original media :(

not only that if you watch these backed up films with friends then this ALSO is copywrite breach under the LAW of RE-BROADCASTING much in the same way as you also break the LAW renting a DVD OR VHS movie and watching with friends AS THEY did not pay the rental fee :confused: ?! weird society we live in but very much true ! this also counts for movies recorded from tv ,cable , satellite or other if watched with other than the people that share your household you are TECHNICALLY rebroadcasting or public viewing and this rule ALSO applies to RADIO broadcasts that you may tape and listen to in the car !? :confused: yeah its all nuts BUT..... its all TRUE :( !? but i dont think the industries will come kick yer door down for sharing the rental and popcorn fees on the latest BLOCKBUSTER rentals or whatever :)

Dear 321 Studios,

I am one of "Blockbusters" very best customers and make copies of DVD's on a regular basis, and of course I do not own such DVD's. I have quite a nice collection now including some of the all time classics and a number of the latest fims too. However, I cannot back them up yet using your very fine software as I do not own a DVDRW drive though I'm saving very hard and should get the chance to enjoy your software in the next month or so.

Come on 321 Studios, I hereby challenge you to take me on! I dare you! :p
