Odd LG GCE-8240B Burning Problems

Ok, here is my dilema, I will try to explain this the best way I can without pics (yet)

Burner in question: GCE-8240B (LG) (Owned 10 months)

Operating Systems: All Windows 9x - Me - 2K - XP (all using different forms of Aspi (mostly 4.60(1021))
Fresh installs each time (Getting frustrated with this one I tell ya)

Software: Nero (Many versions), CloneCD, CDMate, CDRwin, and many others (No Not all installed at once)
(I use CDCheck and CDMage to verify the data after burn)

Media: Fuji, Memorex, Princo, Prime, and others

System - Athlon XP 1800+
512MB DDR Ram
1-20Gig & 1-60Gig Maxtors
Gigabyte GA-7VTXE

The Problem Part 1: (24x) Burning hits about 30% in it's progress - Drive stops, spins up to a higher RPM then finishes burn. You can see a concentric ring change on the cd surface (read side of course) roughly where the pause and restart occured. 5 times out of 10 data verification is BAD.
(what I mean to describe is the first part of burn before the stop is a different shade than the rest of the burn)

The Problem part 2: (Any burn speed) Multisession causes the same concentric ring shading differences between sessions. And 8 time out of 10 the data verification is BAD or it causes a Bad Block to occur and the new session cannot be read at all.

These symptoms to me appear to be more hardware related (like the laser is not calibrating properly or something).

So what I am basically asking is - has anyone else had these problems (and found a solution), or should I take this drive back for exchange (Still under warranty).
