In the US I had a 10gig replaced years ago. I called them and they ran some test you know BS BS and when they came to the same conclusion they took my credit card numbers and sent me another one. Then I had like 30 days to return it or they would charge me some stupid price. But I couldn't tell you when they change the warranty from 3 years to 1 year and I heard the same thing about a bigger drive but I didn't get one. Good luck.

You will be expected to test the drive with Powermax, possibly even just to get a report of "no drive detected".

I haven't done a Maxtor, but I did do a Seagate, and got a 1.7Gb in place of a 1.2Gb - it IS standard practice to upgrade capacity or model, if there is no replacement stock available - the drive supplied will tend to be a factory refurbished model.

Warranties have been shortening, it's rare to find any better than a 1 year these days.

thanks for replies i read their return policy very fussy about how you return the drive very fussy and how its sent courier wise

Thats why I found it best to use the CC so I just put in their box and sent it back. :)

just an update to say that i sent the drive back to maxtor and they sent me a new one that bigger than the one i sent ie 10 gig for a 20 gig nice!!!

winner no one can complain at that and ive had few maxtor drives and never had any problem with them
